40.2.1 This Chapter will be concise because from the perspective of this criminal case study, it is straight forward.

To avoid any future issues, prior to being hired; the writer disclosed to Mr. Landry, that he had been stalked in industry.

Mr. Landry assured the writer that it would not be a problem. The writer expressed that he needed the job to support his two (2) children.

The writer was going through a divorce process after a 21-year marriage’ this initiated post the writer being forced to termination at P&R, now AECOM.

Mr. Landry informed the writer that they had difficulty in finding Electrical- Mechanical Project Co-Ordinators compared to Civil Project Co-Ordinators.

Mr. Landry’s only concern was that the writer was very overqualified, and he was concerned that the writer would leave prior to the two (2) project completion date.

The writer informed Mr. Landry that he needed some time (Sabbatical) from his engineering vocation and that he will return to that field upon completion of this project.

Mr. Landry stated: “I give you my word as a gentleman that you will be guaranteed work without any possibility of layoff as a Project Coordinator on the Burlington WTP project, which is scheduled for completion in March 2004”

“That’s over two (2) years of work. After that you can decide to stay or leave NAC. The only thing I ask is that you agree to stay till the completion of the Burlington WTP Project”

Further, that he would be interested in a potential future possible position of Project Manager for the  writer with NAC in the future.

The writer gave his word that he would stay for the entirety of the Region of Halton (ROH), Burlington Water Treatment Plant Project Upgrade.

The writer relocated from Durham Region, returning to Burlington, Ontario and rented a two (2) bedroom apartment for his young children to stay with him on weekends.

On January 25, 1998,  writer accepted a position as an Electrical - Mechanical Co-Ordinator reporting directly to Mr. Scott McPherson, Project Manager, NAC for the Region of Halton (ROH), Burlington Water Treatment Plant Upgrade.

Both Mr. Landry and Mr. McPherson informed the writer if he had any concern not to hesitate to communicate the concerns to them.

The writer commenced work integrating well into the NAC Project Team.

Mr. McPherson, Project Manager, NAC during the writer’s Employment Review stated to the writer that he was: “The best Electrical-Mechanical Project Co-ordinator that NAC ever had”

Further, the writer negotiated an additional independent contract for his company Boyes Technologies (Presently, BTI Technologies) for the sum of $10,000 paid in quarterly installments by cheque.

40.2.2 During the Summer of 2002, Mr. McPherson, Project Manager informed the writer that Mr. David Ohashi, Special Projects Manager for the Region of Halton (ROH) had approached Mr. Jonathan Hazenberg, E.I.T. and had made enquiries and false allegations with regards to Mr. Boyes, P.Eng. employment with NAC.

The result of this secret meeting was that Mr. Hazenberg, E.I.T. concluded that Mr. Boyes was both a threat to the ROH and NAC.

Mr. Hazenberg’s next actions were to directly contact Mr. Boyes’s direct Supervisor with the intend of terminating Mr. Boyes’s employment with NAC.

Mr. McPherson explained to Mr. Hazenberg that Mr. Ohashi had personal issues with Mr. Boyes. 

Further, that Mr. Boyes was doing a good job for NAC and to leave Mr. Boyes alone.

At this point in time, the writer had never met or even knew of the existence of Mr. Hazenberg.

Mr. Hazenberg, E.I.T. then became the Site Superintendent of the Burlington WTP Upgrade and reported directly to his supervisor Mr. McPherson, Project Manager.

In my first one on one discussion with Mr. Hazenberg he directly stated bluntly out of the blue that he was a “Personal Friend and Professional Colleauge of Mr. Ohashi” for no apparent reason.

Hence, enters Mr. Ohashi's Thug #7 ? mentioned above.

I took the approach of treating Mr. Hazenberg with courtesy and respect. Hoping that this young man would mature and find his own way.

As the project progressed forward successfully with the NAC team working well together, Mr. Hazenberg took a moment to tell me a story of how he had worked on a Dam Project in Western Canada with NAC.

Mr. Hazeberg alleged that there had been a co-worker of his that was disliked by one of the client’s staff.

This employee was terminated.

 

Mr. Hazenberg stated strongly that it was the right thing to do!

Eventually, Mr. Hazenberg disclosed that he had graduated as a Environmental Engineer and that he had tried working in his field Environmental Engineering, then government and he intended to advance in his career with NAC.

There was no reason for this conversation to occur between us, we were not friends, simply co-workers.

The writer checked online to confirm that Mr. Hazenberg had graduated from Carleton University with a bachelor’s degree in environmental engineering 1992 – 1996.

As the month’s past, I observed that Mr. Hazenberg developed a pattern of aggression, conflict with unionized workers, ROH staff, the ROH’s ‘Engineer’ CHM2 Hill staff onsite and even engaging in public screaming matches in open view of all onsite.

Mr. Hazenberg’s growing pattern of aggression and his ongoing demonstration of a low emotional quotient was apparent.

 

Emotional Intelligence, the ability to understand, use, and manage your own emotions in positive ways to relieve stress, communicate effectively, empathize with others, overcome challenges and defuse conflict.

The writer continued with his approach, treating Mr. Hazenberg with courtesy and respect, hoping for the best. He was talented. However, he demonstrated that he had some obvious personal demons.

An incident occurred onsite where a unionized local construction worker had been injured and was off on WCB. This worker returned to work and was assigned working with a rivet buster, a smaller jack hammer.

I mentioned to Mr. Hazenberg that this worker was working extensively on this difficult hard labour job busting concrete holding the rivet buster vertically for many days. I was concerned with his injury and the obvious pain, if this was the best job currently for him.

Mr. Hazenberg indicated his displeasure with him filling a claim with the WCB.

The writer knew this man was local to Burlington, Ontario and that he needed the money to support his family. He was in obvious pain.

As time went on, Mr. Hazenberg layed him off due to a claimed shortage of work. Mr. Hazenberg volunteered that he had waited for two others who were scheduled for layoff to include this individual in the layoff so to camouflage his layoff in the group of three.

Mr. Hazenberg scoffed, explaining with glee that the worker had allegedly fell on the way off the job site.

The writer often worked a 70-hour work week even though he was salaried for about 37 to 38 hours weekly.

The writer was enjoying his ‘Work Sabbatical’, seeing the project progress while spending time with his children and doing some self improvement looking forward to restarting his engineering career upon completion of this project in 2004.

The writer was very often the first to open the site gates and last to leave site.

In the onsite NAC construction office, a pattern started to emerge. Mr. Hazenberg would stay late after all staff had left except him and the writer, Mr. Hazenberg often would engage in telephone conversations, raising his volume levels so that the writer could hear him from the other end of the site office.

Mr. Hazenberg would be on the telephone stating loudly that he wanted to be the WTP Project Manager to Mr. Landry, VP, NAC, Mr. Ohashi Special Projects Manager, ROH and just about anyone else who would listen.

The writer remembered that Mr. Ohashi Thug #0? Very clearly explained one of his bribery methods.

  1. Bribery Methods: Mr. David Ohashi, P.Eng. alleged to Mr. Boyes, P.Eng. that you do not have to bribe a person with cash, you can get them, their family or friends hired or promoted.

 

Mr. Hazenberg would often make requests to the writer that had nothing to do with his position, on one occasion; Mr. Hazenberg requested that the writer print pictures of his family on the company computer system. Something that he could have done himself.

The writer just put it down to his need to demonstrate, probably to himself; he had some position of power?

The writer continued to be kind and courteous to Mr. Hazenberg while carrying out his duties as Electrical – Mechanical Project Co-ordinator.

At this point Christmas 2003 was approaching, and the writer was looking forward to a good break from work with his young children.

Plus, planning re-entry into the engineering field in March of 2024, once this NAC project was successfully completed.

The writer had given his word to stay for the duration and he had developed a couple of basic rules in life and for engineering:

- Keep your word.

- With respect to projects, there will be more project opportunities, if you endeavor to complete the current project and everything works to the client reasonable satisfaction.

- An Engineer should master at least one or more areas of engineering before acquiring a position as an engineering project manager.

The writer was happy to be free of the toxic and criminal environment of Mr. Ohashi and his criminal network of Thugs.

Or so he believed.

40.2.3 The year 2003, commenced the execution of Mr. Ohashi, Thug #0 Sanction’s by the Pernicious Manipulator and Perpetrator Mr. Johanthan Hazenberg, P.Eng., Mr. Ohashi’s Thug #7?

On or about January 2003,

- Mr. Gerald Landry, VP, NAC upon the direction of Mr. Hazenberg (Mr. Ohashi ROH) showed up and effectively informed the writer that they were changing his job tittle to Commissioning Engineer with an alleged $20,000 salary increase.

- There was no job posting.

- There was no job description.

- The writer did not apply for this position.

- The writer was already employed as the Electrical – Mechanical Project Co-ordinator for NAC and was guaranteed the position until the project completion in March 2004.

- The writer had an excellent performance evaluation by his direct Supervisor Mr. Scott McPherson, Project Manager, NAC.

Mr. Scott McPherson, Project Manager, expressed many times his assessment of the writer’s performance as a Project Coordinator, below are some of his statements:

- “Bruce is the best Electrical-Mechanical Project Coordinator NAC has ever had”

- The writer listened to the verbal description of the so-called Commissioning Engineer position.

 

It was the exact position the writer was employed in as the Electrical – Mechanical Project Co-ordinator for NAC!

- The writer stated that it is the same position he already was employed in. There was no disagreement.

- It was obvious that if the writer had refused, the writer would be constructively terminated.

 

- The $20,000 promised pay increase was never paid, not even a penny appeared on the writer’s NAC salary!

Note: Mr. Hazenberg had  just recently received his P.Eng. designation.

 

Background/events prior the writer’s wrongful constructive termination,

Firstly, Mr. Hazenberg had taken time off for 3 weeks, his wife was having a child.

However, he just showed up onsite at various times creating issues.

 

Mr. Hazenberg appeared to sabotage the ROH Burlington WTP Project operation for three weeks prior to the writers wrongful termination:

- Mr. Scott McPherson, Project Manager, NAC (10 years experience with NAC) informed the writer that he feared that if Mr. Hazenberg became Project Manager the 48-million-dollar Project would fall behind schedule because the foremen and tradesmen did not respect him.

-Mr. McPherson alledged that Mr. Hazenberg had a problem with Humility.

- Two of the four long-term NAC foreman informed the writer that if something was not done about Mr. Hazenberg, they were thinking of seeking employment elsewhere.

 

- Mr. Hazenberg had a confrontation with a one unionized tradesman resulting in the tradesman threatening to "Punch Him in The Head", if Mr. Hazenberg ever talked to him in that manner again.

 

- The NAC unionized tradesmen nicknamed Mr. Hazenberg: "Hitler"

 

- The Head ROH Plant Operator and the ROH Liaison on this Project commented: "I don't agree with the nickname, but I understand why the tradesmen gave it to him"

 

Allegedly, this gentleman withdraw as ROH Liason because he refused to deal with Mr. Hazenberg.

Note: Just prior to our last weekly meeting Mr. McPherson informed the team he would be away from site for about one week on business.

​In our last weekly meeting all four of the Foremen (Electrical - Mechanical - Civil and Filters), the Site Safety Officer and the Civil Project Co-ordinator ordered me to take action to address the onsite problem of Mr. Hazenberg to management.

The foremen reported that Mr. Hazenberg came onto a very busy and highly scheduled site. Allegedly, Mr. Hazenberg would call some of the scheduled trades, vendors and suppliers who were scheduled to be onsite changing some of the dates and times with some but not all creating complete havoc to the pre-arranged site operations.

Even the receptionist complained, Mr. Hazenberg would come in early and take the messages she had to deliver or notify people with and Mr. hazenberg removed them so she could not do her job.

 

It created communications breakdowns.

In the last 3 weeks, his actions were crippling site operations.

​The Site Safety Officer (Brother In-Law) of the NAC Vice-President and the Civil Project Co-ordinator advised that it was NAC policy to write a letter to the Project Manager who was his direct Supervisor so that he could address the issue.

​I wrote the letter.

The writer had both the Site Safety Officer (Brother In-Law of the NAC Vice-President) and the Civil Project Co-ordinator review the letter for content and accuracy.

 

They both said that it reflected exactly what had transpired.

​The writer considered carefully faxing the letter. It came down to doing my job, or not doing my job.

The circumstance was both a safety issue and it was crippling site operations.

The result should have been that the Project Manager would speak to the writer so he could explain, and then the Project Manager could delicately address and resolve the matter so that Mr. Hazenberg might adjust his manner, and all team members could move forward together.

In February 2003, Mr. Hazenberg P.Eng. wrongfully terminated the writer without cause within 1 to 2 hours of Mr. Hazenberg P.Eng. claiming the NAC Project Manager’s position at the Burlington WTP Project, which the writer was employed on.

Mr. Hazenberg, P.Eng liked to 'Proclaim' Himself GOD!!! Extreme Hubris Level!!!

Mr. Hazenberg stated: I am now officially the new Project Manager for the Burlington WTP Project.

Mr. Hazenberg stated: I am your boss now, that’s means you do whatever I say, without question.

The writer responded: Ok.

Mr. Hazenberg stated: Let me make it clear, I am NAC. Do you understand?

The writer responded: Ok.

Mr. Hazenberg stated: No I do not think you understand, with regard to you, I am God!

The writer responded: Well, all I can say is that I have done a great job for NAC to date, and I will continue to do so.

 

Mr. Hazenberg stated: I am your boss now. I will decide if you have done a good job or not.

 

I Deem that you have not done a good job. You are Fired!

 

The writer has obtained documentation via the Privacy Act from Human Resources Development Canada (HRDC) that indicates the writer's employers have organized and contacted the writer's present employer resulting in the writer sustaining the loss of his gainful employment in the amount of $XX,XXX per year.

The HRDC Supplementary Record of Claim states: "Employer (Mr. Hazenberg) stated that they had been warned by a customer (Mr. Ohashi) and claimant's former employers (now AECOM) that claimant had a history of having disputes with his employers"

In the Memorandum Form dated March 19, 2003 Mr. Jonathan Hazenberg, P. Eng. Project Manager states: "I felt Bruce was more of a liability to be on-site given his track record with previous employers and he obviously wanted to leave so I simply granted his request"


Note: Mr. Hazenberg first fired the writer without cause, and then later claimed the writer was laid off due to shortage of work, then hired the writer's replacement, then later admitted the writer had been fired.

The writer believes now that Mr. Hazenberg, P.Eng. was in the pocket of the now Convicted Criminal working in the ROH, Mr., David Ohashi, P.Eng.

The writer believes that the termination was mandatory for Mr. Hazenberg to be supported by Mr. Ohashi (ROH) to get his promotion, BRIBE!

In this section 40.2.4, Information Excerpts from Certified Court Transcript(s), Government Documents and NAC Documents:

​40.2.4 The years 2007 - 2008, commenced the involvement of the Pernicious Manipulator and Perpetrator Mr. Johanthan Hazenberg, P.Eng., Mr. Ohashi’s Thug #7?. as the sole witness to testify for the other Party in a Family Court Matter between the writer and his ex-wife.

​The writer believes that this testimonial involvement of Mr. Hazenberg's was misleadingly perjurious and perverted the course of justice.

​This matter and subsequent resultant injuries and damages were finally concluded some fifteen plus years later.

Facts,

  • The writer only held one position with North America Construction, Electrical-Mechanical Project Co-ordinator, which encompassed the entirety of the project, the Region of Halton Burlington WTP Expansion (Upgrade).

 

  • Mr. Hazenberg orchestrated a game of musical chairs with job tittles to premise a reason to terminate the writer. The tittle was initially to change to Commissioning Engineer. It was the same position. It must be noted that a $20,000 salary increase was to accompany the Commissioning Engineer charade. The increase was never paid!

 

  • The opposing counsel discussed the ‘Commissioning Engineer’ with the writer during pre-trial. However, when the writer presented argument(s) to the opposing counsel, Mr. Hazenberg, P.Eng. while testifying under oath at trial indicated that it was not ‘Commissioning Engineer’ but adapted the charade to ‘Commissioning Manager’. A complete unbounded lie of supreme arrogance in the writer’s opinion. The look on the opposing counsel spoke volumes!

 

  • Regarding the letter that the writer was ordered to prepare to address the concerns of the project team pursuant to Mr. Hazenberg’s several weeks of sabotaging NAC site operation prior to the wrongful termination of the writer; Mr. Hazenberg admitted that the writer had NOT been terminated because of the faxed letter.

 

Further, the writer believes Mr. Hazenberg while treacherous was sufficiently competent not to have sabotaged NAC operation accidentally or by mistake. Mr. Hazenberg perpetrated these actions just prior to Mr. Scott McPherson being scheduled away from site on business.

 

  • Regarding cause for the writer’s wrongful termination, the writer during cross examination of Mr. Hazenberg presented a question(s) to Mr. Hazenberg as to what specifically from the moment of the writer’s first day a an employee to the moment the writer was terminated by Mr. Hazenberg, 'What specifically, did the writer do to be terminated?'

 

Mr. Jonathan Hazenberg, P.Eng.’s Response: Nothing really.

 

  • Why then did Mr. Hazenberg do it?  The support for promotion to Project Manager!

  • Why did NAC allow this to happen? Mr. Ohashi ROH Approved, Additions, Changes and Deletions for NAC that increased the Project from $40,000,000 to $48,000,000 on or about the time of the writers wrongful termination. Plus, his ability to effect short listing and/or sole sourcing on future projects. Quid pro quo

Mr. Ohashi, P.Eng., Region of Halton (ROH) by his own declaration had a minimum of $100 million  of our tax dollars each year.

The Arrest of the Now Convicted Criminal Mr. David Ohashi, P.Eng. did not occur until 2016!

That means Mr. David Ohashi, P.Eng. had $1.8 Billion of our tax dollars to harm my young family and the writer.

Witness Statements 2005

In 2005, I met Mr. Rob Poland, Mechanical Foremen, North America Construction Ltd. (NAC) in Home Depot, Burlington.

 

Mr. Poland told me that Mr. David Ohashi had asked NAC for a kick-back. ($50,000)

 

In 2005, I met Mrs. Mary McCready, Receptionist, North America Construction Ltd. (NAC) in a grocery store located at Walkers Line and Upper Middle Rd. ,Burlington, Ontario.

 

Mrs. McCready told me that Mr. Hazenberg stated “Kick-backs are just a fact of life when doing business with Halton Region. (Location: NAC Site Office, Burlington WTP)

At this point, this had been contining for approximately seven years.

Witness Statements 2006 - 2007 Updated - Summons Process Pre- Trial

Prior to the Trial, the writer in the process of issuing Summons to a number of Witnesses.

Here, I will cover the above two (2) witnesses by name: 

i) Mrs. Mary McCready, Receptionist, North America Construction Ltd. (NAC)

Mrs. McCready when the writer discussed her testimony broke down into tears stating that she was approaching retirement age and that if the writer Summoned her to testify that NAC would fire her just like they fired the writer.

She became hysterical and demonstrated true extreme fear. Mrs McCready terrified, pleaded not to call her.

ii) Mr. Rob Poland, Mechanical Foreman, North America Construction Ltd. (NAC)

Mr. Poland when I discussed his testimony became extremely animated, he informed the writer that he was going through a divorce and did not want to be summoned. Mr. Poland displayed fear for his job, then anger that he will be called to testify.

 

Mr. Poland finally yelled in anger that if you Summon him that he would lie in Court. He terminated the telephone call.

Both witnesses in 2005 freely volunteered their statements. 

During the time preceediing Trial they demonstrated true fear of losing their employment with NAC and could only be classified as hostile  witnessses.

Another witness prior to Trial claimed an injury prevented him from testifying, complete with a medical note.

The wittness, Mrs.  Joyce Salovine, ROH Chairperson will be discussed briefly in the main body section 40.2.3

 

Other witnesses and potential witnesses for the writer's side will not be discussed at this time for there protection.

 

The only witness that apparently did appear was Mr. Jonathan Hazeneberg, P.Eng. as the sole witness for the Other Party.
